Welcome to GuardianView. These Terms of Service (“Terms”) govern your access to and use of the GuardianView Android application and services (the “App”). By creating an account or using the App, you agree to be bound by these Terms.
1. Service Description
GuardianView is a parental monitoring application that enables parents and legal guardians to:
- Capture screenshots from a child’s Android device
- Listen to live audio from a child’s device microphone
- View screenshot history
- Manage paired child devices
2. Eligibility and Intended Use
You must be at least 18 years of age to create a GuardianView account. By using this service, you represent and warrant that:
- You are the parent or legal guardian of the child whose device you are monitoring.
- The device being monitored is either owned by you or you have legal authority over its use.
- You are responsible for complying with all applicable laws regarding monitoring and surveillance in your jurisdiction.
3. Prohibited Uses
You agree not to use the App to:
- Monitor any person who is not a minor child under your legal guardianship
- Conduct surveillance of adults without their explicit consent
- Monitor devices in violation of local, state, national, or international laws
- Engage in stalking, harassment, or any illegal activity
- Reverse engineer, decompile, or disassemble the App
- Attempt to circumvent security measures or access other users’ data
4. Accessibility Service
The child device component uses Android’s Accessibility Service to capture screenshots. This service:
- Is enabled by the parent during device setup
- Only captures screen content when triggered by the parent
- Does not collect passwords, keystrokes, or form data
- Can be disabled at any time by the parent through the App
5. Privacy and Data
Your use of the service is also governed by our Privacy Policy. You acknowledge that the App requires permissions (Accessibility Service, Microphone) to function. You are responsible for ensuring these permissions are granted only on devices you have the legal right to monitor.
- Screenshots are stored for 30 days and then automatically deleted.
- Audio is streamed in real time and is not recorded or stored.
- You may delete your account and all associated data at any time through the App.
6. Subscriptions and Payments
6.1 Free Tier
The free tier includes limited functionality:
- 1 audio listening session per day (maximum 30 seconds)
- On-demand screenshot capture
- 1 paired device
6.2 Premium Subscription
- Premium subscriptions are managed through Google Play.
- Subscription pricing is displayed in the App before purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription through Google Play Store settings.
- Refunds are handled according to Google Play’s refund policy.
7. Service Availability
The monitoring features depend on internet connectivity and Android OS stability. We strive to maintain high availability but do not guarantee that the service will be uninterrupted or error-free. We may perform maintenance that temporarily affects availability.
8. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided “as is” without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
- Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
- We are not responsible for actions taken based on monitoring data, or for any failure to capture screenshots or audio.
9. Termination
- You may stop using the App and delete your account at any time.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your data will be deleted in accordance with our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
