Welcome to GuardianView. These Terms of Service ("Terms") govern your access to and use of the GuardianView Android application and services. By creating an account or using the application, you agree to be bound by these Terms.
1. Eligibility and Legal Authority
You must be at least 18 years of age to create a GuardianView account. By using this service, you represent and warrant that:
- You are the parent or legal guardian of the child whose device you are monitoring.
- The device being monitored is either owned by you or you have legal authority over its use.
2. License and Restrictions
GuardianView grants you a personal, non-exclusive, non-transferable license to use the app for personal, non-commercial parental monitoring purposes. You agree NOT to:
- Use the service to monitor any adult or individual without their express, legal consent.
- Modify, decompile, or reverse-engineer the Android application.
- Use the live audio or screen recording features for any illegal or malicious purposes.
3. Privacy and Data Security
Your use of the service is also governed by our Privacy Policy. You acknowledge that the app requires invasive permissions (Accessibility, Microphone, Screen Capture) to function. You are responsible for ensuring these permissions are granted only on devices you have the legal right to monitor.
4. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.
The monitoring features depend on internet connectivity and third-party Android OS stability. We do not guarantee that the service will be uninterrupted or error-free.
5. Subscriptions and Payments
Some features require a paid subscription. Subscriptions are managed through the Google Play Store. Payment terms, renewal, and cancellation are governed by the store's policies. You may cancel your subscription at any time through your store account settings.
6. Termination
We may terminate your access to the service if we believe you are using the app in violation of local laws or these Terms (e.g., unauthorized monitoring of non-minors). Upon termination, your right to use the service will immediately cease.
7. Changes
We reserve the right to modify these Terms at any time. Updates will be communicated via the App or website with a revised “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the updated policy.
8. Governing Law
Except for disputes that can be brought in small claims court, all disputes between you and us, including any dispute regarding this Agreement, shall be exclusively settled through binding arbitration through the American Arbitration Association (“AAA”) pursuant to the AAA’s then-current rules for commercial arbitration. Any such arbitration proceeding will be conducted solely in English.
These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. If the arbitration in this section provision is found unenforceable or not to apply for a given dispute, then the proceeding must be brought exclusively in a court of Delaware jurisdiction.
